Benjamin Gutierrez, 57, was taken into custody March 24 by West Covina police detectives and the U.S. Marshal Service Pacific Southwest Region Fugitive Task Force. Gutierrez was booked on suspicion of lewd acts on a child under 14 years of age, according to the West Covina Police Department. Gutierrez was arrested at 6:37 a.m. and booked at 7:52 a.m. He is being held in lieu of $30p,000 bail ahead scheduled for an appearance in Pomona Superior Court March 28,according to Los Angeles County booking records. The driver is still listed as John Doe #63, according to Sarah Ardalani, public information officer for the Los Angeles County Department of Medical Examiner-Coroner. The collision occurred near South Nogales Avenue and Amanda Avenue around 3:35 a.m. Firefighters arrived and found the driver trapped inside the burning vehicle. The fire was extinguished and the driver, the only occupant, was declared dead at the scene, according to the West Covina Fire Department. The cause of the collision is under investigation by the West Covina Police Department’s Major Accident Investigation Team. The shooting was reported around 3:16 a.m. in the 100 block of North Grand Avenue. The victim and two suspects became involved in an unspecified confrontation. One of the two suspects produced a handgun and shot the victim, according to Public Information Officer Alexus Napoles of the West Covina Police Department. Both suspects fled. Napoles did not have suspect descriptions available, nor a possible motive. The driver died at the scene of the crash at South Nogales Street and Amanda Street. Authorities were called to the scene around 3:35 a.m., according to the West Covina Police Department. Only one vehicle was reportedly involved in the crash and the unidentified driver was the sole occupant, according to the West Covina Police Department. The West Covina Police Major Accident Investigation Team is determining how and why the crash happened.
